These Terms of Service ("Terms") govern your access to and use of Giterra, a group-travel companion application and the related websites and services (together, the "Service"). Please read them carefully — by using the Service you agree to be bound by them.

1. Acceptance of These Terms

By creating an account, downloading the app, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, you may not use the Service. If you use the Service on behalf of a group, you confirm that you are authorised to accept these Terms for the activities you carry out within that group.

2. Overview of the Service

Giterra helps people travelling together coordinate a trip in one place. Depending on the tools a group chooses to enable, the Service may let you split and track shared expenses, settle balances, share photos and files, store travel documents, share your location with other trip members, and plan an itinerary. Features evolve over time and some are available only on premium trips. We may add, change, or remove features at our discretion.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

4. Your Account

You access the Service through an account. You are responsible for keeping your sign-in credentials confidential and for all activity that occurs under your account. Notify us promptly if you believe your account has been compromised. You may close your account at any time; some information may be retained as described in our Privacy Policy and as required by law.

5. Group Trips and Members

The Service is organised around trips. A trip member who creates or administers a trip may invite others, manage which tools are enabled, and remove members. When you join a trip you may see, and be seen by, other members of that trip, including their contributions to shared content, expenses, and — where enabled — their location. Treat information shared within a trip as visible to that group. You are responsible for the people you invite and for content you contribute to a trip.

6. Shared Expenses and Settlements

The expense tools let trip members record costs, split them between participants, and view who owes what. Balances and suggested settlements are calculated automatically from the entries that members add. These figures are provided for convenience only: Giterra does not process, hold, or transfer money, is not a party to any debt between members, and does not verify the accuracy of amounts entered. Marking a balance as settled records that members consider it resolved between themselves; any actual transfer of funds happens outside the Service. You are solely responsible for the accuracy of the amounts you enter and for resolving disputes with other members.

7. Member Location Sharing

If a trip enables location sharing and you choose to turn it on, other members of that trip may see your approximate or real-time location for the period you select. Location sharing is always under your control: you may stop sharing at any time, and sharing ends automatically after the duration you choose. Do not rely on the Service for safety-critical purposes or in emergencies. We are not responsible for how other members use location information you choose to share with them.

8. Travel Documents and Files

The Service lets you upload and store travel documents, photos, and other files for a trip, and to make them available to other members of that trip. You are responsible for ensuring you have the right to upload and share each file and that doing so does not infringe anyone's rights or applicable law. Keep your own backups of anything important — while we take reasonable measures to protect stored files, the Service is not a substitute for a personal backup.

9. Premium Trips and Payments

Some features are available only on premium trips. Premium is unlocked for an individual trip through a one-time in-app purchase made and billed through the app store for your device; the price is shown to you before you buy. A premium trip is a one-time purchase, not a subscription — it does not renew automatically and there is no recurring charge. Premium applies only to the trip it was purchased for and is not transferable to other trips. Refunds are handled according to the rules of the app store through which you purchased, except where the law gives you additional rights. If premium is refunded or otherwise removed from a trip, premium features may become unavailable while the content you created remains accessible subject to the free-tier limits.

10. Your Content and Licence

You keep ownership of the content you add to the Service, including expenses, messages, photos, files, and notes ("Your Content"). To operate the Service we need permission to use it: you grant Giterra a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for technical display, and share Your Content with the trip members you direct us to, solely to provide and improve the Service. This licence ends when you delete Your Content or close your account, except for copies retained in routine backups for a limited time or where retention is required by law. You are responsible for Your Content and confirm you have the rights necessary to share it.

11. Acceptable Use

You agree not to misuse the Service. In particular, you will not: use it for any unlawful purpose or in breach of others' rights; upload content that is illegal, infringing, harmful, or that you have no right to share; harass, impersonate, or violate the privacy of other members; attempt to gain unauthorised access to the Service or to other accounts; interfere with or disrupt the Service or the infrastructure it runs on; or use automated means to access the Service except as we expressly permit. We may suspend or limit activity that we reasonably believe breaches this section, and you agree to indemnify us against claims arising from your misuse of the Service.

12. Third-Party Services

To deliver the Service we rely on third-party providers — for example, mapping and location providers, payment and in-app-purchase processors, authentication and cloud-infrastructure providers, analytics and crash-reporting providers, and email and notification-delivery providers. Some features may also link to or interoperate with services we do not control. We are not responsible for third-party services, and your use of them may be subject to their own terms. We describe these providers by category rather than by name, and the specific providers we use may change over time.

13. Intellectual Property

The Service itself — including its software, design, text, graphics, and the Giterra name and logo — is owned by Giterra or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service for its intended purpose. Nothing in these Terms transfers any of our rights to you, and you may not copy, modify, distribute, reverse engineer, or create derivative works from the Service except as permitted by law.

14. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that calculations, locations, or stored files will be accurate or always available.

To the fullest extent permitted by law, Giterra will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us, if any, for the Service in the twelve months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service, giving you reasonable notice where practicable. On termination, your right to use the Service ends; sections that by their nature should survive — including content licences already granted for backups, disclaimers, limitations of liability, and the governing-law provisions — continue to apply.

16. Changes, Governing Law and Contact

We may update these Terms from time to time. When we make material changes we will update the "last updated" date above and, where appropriate, notify you within the Service. Your continued use after changes take effect means you accept the revised Terms.

These Terms are governed by the laws applicable at Giterra's principal place of business, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rights you have where you live.
